Police Urge Compliance with
Town’s Animal Ordinance
The Town of Rome has updated Ordinance
9.02(4)(a) Loud and Unnecessary Noise Prohibited. The updated
Ordinance now reads:
(4) LOUD AND UNNECESSARY NOISE
PROHIBITED:
(a) Loud and Unnecessary Noise
Prohibited:
1. No person shall make or assist in
making any noise tending to unreasonably disturb the peace and quiet
of persons in the vicinity thereof. The presence of noise at the
following decibel levels, as measured from any portion of any parcel
adjacent to the parcel that is the source of the noise, shall be
considered prima facie evidence that the peace has been unreasonably
disturbed as prohibited in this Section.
a. Eighty (80) decibels or more between
the hours of 7:00 am and 10:00 pm.
b. Sixty (65) decibels or more between
the hours of 10:00 pm and 7:00 am.
2. Noise created between the hours of
7:00 am and 8:00 pm by normal yard maintenance, farming, timber
harvesting, and construction activities shall be exempt from this
Section.
This change places specific decibel
levels on the amount of noise allowed, along with hours of the day
when noise levels must be reduced. This change will give officers
investigating noise complaints a bright line rule when making the
determination if there is a violation of the noise ordinance.
False alarms to be monitored in Rome
The Rome Town Board is in the process of
adopting a resolution into Rome’s Code of Ordinances in hopes of
reducing the number of false emergency alarms occurring in the Town of
Rome. Emergency services in Rome routinely respond to burglary, panic,
and fire alarms which turn out to be falsely activated either by the
alarm user, or due to poor maintenance of the alarm system. This
resolution would set a penalty schedule for emergency services
responding to numerous false alarms within a calendar year. Please see
the proposed resolution below. Currently the resolution is scheduled to
become official town ordinance in July of 2007.
EMERGENCY ALARM SYSTEMS
(1)Purpose: The primary purpose of this
ordinance is to reduce the number of false emergency alarms. It is also
meant to encourage the installation of quality alarm systems to insure
maximum safety and protection of persons and property. This section
will also impose standards and requirements for negligence of the user
of an alarm system or of employees operating an alarm system.
(2) Definitions:
a. Alarm User: Means any person on whose
premises an alarm system is maintained within the Town of Rome.
Exceptions would be vehicle alarms.
b. False Alarms: means any of the
following: The activation of an alarm through negligence of the owner,
lessee, employee or any agents.
Activation of an alarm from mechanical
failure or malfunction due to improper maintenance of the alarm.
Activation of an alarm due to improper
installation.
(Alarms that are activated due to adverse
weather conditions will not be included as false alarms.)
Hold-Up Alarm System: means any alarm system
that is activated by a person committing a crime or an employee of the
protected premises.
Localized Alarm System: means any alarm
system that when activated causes an audible or visual signaling
device. This is considered an on-premise alarm system.
Residential Alarm: means an alarm system
that is installed to protect a private residence.
Fire Alarm: means an alarm system which is
designed to activate when fire is detected inside a structure.
(3) False Alarms; (Hold-Up, Local,
Residential, Fire): The owner, lessee, or agent of any alarm mentioned
in this section shall be assessed a fee for each false alarm activated
after three occurrences in a 12-month period.
4th occurrence - $50.00 / 5th
occurrence - $100.00 / 6th and subsequent occurrence -
$200.00
The penalty scale will terminate 12-months after the 1st occurrence and
repeat itself. |
